These General Conditions have as their object the purchase of products and services, carried out remotely via the internet on the site www.norac.it, belonging to Norac – Win Parts di Dal Molin Luca – VAT number 04494840244 – Via Papa Luciani 9 – 31037 Loria (TV) – Italy.
1) Acceptance of the general conditions of sale.
1.1) The contract stipulated between Norac and the Customer shall be deemed concluded with the acceptance, even partial, of the order by Norac according to the methods described in points 2.2, 3.1, 3.2. By placing an order in the various ways provided, the Customer declares that he has read all the information provided to him during the purchase procedure, and that he fully accepts the general and payment conditions transcribed below.
1.2) If the Customer is a consumer (i.e., a natural person purchasing the goods for purposes not related to their professional activity), once the online purchase procedure has been completed, they will print or save an electronic copy and in any case retain these general conditions of sale, in compliance with the provisions of Articles 3 and 4 of Legislative Decree 185/1999 on distance selling.
1.3) The Customer is not entitled to any compensation or damages, nor is he liable under any contractual or extra-contractual law for direct or indirect damages to persons and/or property caused by the failure to accept or fulfill, even partially, an order.
2) Purchase method:
2.1) The Customer may only order products listed in the Norac electronic catalogue at the time of placing the order and viewable online at (URL) http://www.norac.it, as described in the relevant information sheets. It is understood that the image accompanying the product description sheet may not be perfectly representative of its characteristics but may differ in colour, size, and accessory products shown in the image.
2.2) Correct receipt of the order is confirmed by Norac via email, sent to the email address provided by the Customer. The response is generated automatically by the system and cannot in itself be considered acceptance of the order, but only confirmation of receipt.
2.3) This confirmation message will include the date and time the order was placed and a 'Customer Order Number', to be used in all further communications with Norac. The message contains all the data entered by the Customer, who undertakes to verify its accuracy and communicate any corrections promptly, according to the methods described in this document. The order confirmation is sent at the same time as the shipment for unregistered customers.
3) Order Status:
3.1) The order status can only be viewed by customers registered in the "My Orders" section of the Norac.it website. There are three viewable statuses, which identify the three possible order statuses:
- 'Paypal Payment Authorized: Indicates that the Paypal payment has been successfully processed by Paypal and has already been received.
- "Awaiting Payment": this is the status generated when you choose to pay by "Bank Transfer" or "Postepay". Once received, it will be updated to "Order Shipped".
- "Order Processing": Your order is being prepared for shipment or some items are missing from the complete shipment. In this case, you will be notified immediately.
- 'Order Shipped': this is the status that certifies that the order has been shipped.
4 Payment Methods:
4.1) Cash on delivery: Payment in cash (banknotes) upon delivery. Maximum amount €1000 including VAT. Available only for deliveries in Italy. Cash on delivery has an additional cost.
4.2) Bank transfer: to be sent only after our order confirmation email.
4.3) Credit card/Paypal: to be completed at the time of placing the order.
At Norac's discretion, or if the order amount exceeds €1,000 (including VAT), or for items made to order or specifically requested by the customer, Norac reserves the right to request advance payment for the requested supply, to be paid in advance exclusively by bank transfer.
5 Delivery methods:
5. 1) Norac accepts orders for delivery worldwide using express couriers selected based on the destination.
5.2) For each order placed, Norac applies the provisions of:
pursuant to art. 22 of Presidential Decree 633/1972, according to which there is no obligation to issue an invoice unless expressly requested by the customer no later than the time the order is placed;
Article 2 of Presidential Decree 696/1996 regarding the exemption from issuing receipts or tax receipts for the sale of tangible goods via indirect e-commerce.
5.3) Shipping costs are the responsibility of the Customer and are explicitly highlighted when placing the order. Payment for the goods will be made using the method chosen when placing the order. The Customer owes nothing more than the order total unless otherwise agreed and confirmed by the Customer (e.g., adding products to the order).
5.4) Norac cannot be held responsible for any delays in processing the order or in delivering the items ordered.
5.5) Unless otherwise specified by our Customer Service, delivery is intended to be at street level. Upon delivery of the goods by the courier, the Customer is required to check:
The number of packages delivered corresponds to that indicated in the accompanying document
The identity and quality of the products, if indicated on the packaging, correspond to that indicated in the accompanying document.
Any discrepancy in the number of packages or the information provided, as well as any loss or damage, must be immediately reported to the carrier. If the goods are collected, they must be accepted with a written "reservation." Once the courier's document has been signed, the Customer will no longer be able to raise any objections regarding the external characteristics of the goods delivered.
If you pick up your items at our Mussolente store, you can check the accuracy and integrity of the items with the store manager before paying.
6) Cancellation, Withdrawal and Refunds
6.1) The customer may cancel the order until it has been shipped, after which he or she may, after receiving and possibly paying (cash on delivery), withdraw in accordance with the procedures established by law.
6.2) All distance purchases made by telephone or mail, since they occur outside of commercial premises, are subject to Legislative Decree no. 185 of 22/05/1999, which provides the buyer with the right of withdrawal. The right of withdrawal applies to final consumers who are natural persons acting for purposes that can be considered unrelated to their commercial activity (those purchasing for non-professional purposes, i.e., without a VAT number). It does not apply to professional consumers (those purchasing for professional purposes, i.e., with a VAT number).
6.3) The right of withdrawal applies to all unused products packaged as originally packaged. It does not apply to the supply of goods made to measure or clearly personalized, or which, by their nature, cannot be returned or are liable to deteriorate or expire rapidly.
6.4) By law, your intention to withdraw must be communicated via registered mail with return receipt within 10 days of purchase. To offer a faster service, Norac also accepts withdrawal notices sent via email. Before shipping, we ask you to contact us to obtain an RMA (return merchandise authorization) number, which is necessary for the return. Please ship the products to be returned in their original packaging, writing the RMA number on the package. Our address is Norac – Via Verdi 25 – 36065 Mussolente - Vicenza - Italy. Please attach a copy of the invoice and a communication from you indicating the products and quantities being returned, the bank details for the transfer (ABI - CAB code - Current Account of the invoice holder), and, if the account holder is different, also attach a copy of your authorization and that of the account holder.
6.5) Return shipments without a copy of the notice of intent to exercise the right of withdrawal, or without a copy of the invoice or RMA number on the package, will not be accepted by the Norac warehouse. Shipments paid for by cash on delivery or otherwise will not be accepted. The consumer is responsible for the direct cost of returning the goods to the sender. If the consumer requests that Norac handle the return shipment, Norac has the right to accept or refuse this task. If Norac accepts this task, it cannot be held responsible for any risks arising from the shipment (except where the consumer requests optional paid insurance coverage). The cost of the return shipment, even if handled by Norac, is the responsibility of the consumer and is approximately double the cost of the original shipment. 6.6) If the above procedure is followed correctly, Norac will credit the Customer as soon as possible (within 30 working days of receiving the goods) for the amount paid on the invoice, excluding shipping costs (Article 5, paragraph 6, Legislative Decree No. 185 of 22/05/1999). In the case of shipments returning from non-EU countries, any customs duties due for the return will be borne by the customer. Refunds for orders paid by cash on delivery or bank transfer will be made exclusively by bank transfer. Refunds for orders paid by credit card or PayPal will be made exclusively by reversing the payment to the card or PayPal account. We encourage customers to avoid using expiring credit cards.
6.7) In promotions, where the purchase of one item is combined with another item sold at a discounted price or given away, the right of withdrawal may be legitimately exercised by returning both items purchased, given the accessory nature of the promoted item compared to the first. In the case of promotions that include two or more items and for which the promotion, and therefore the special price or discount applied, exists due to a combined purchase, the right of withdrawal applies to all the items covered by the promotion.
6.8) Refunds for orders paid by cash on delivery or bank transfer are processed exclusively via bank transfer. Refunds for orders paid by credit card or PayPal are processed exclusively by reversing the payment to the card or PayPal account. We encourage customers to avoid using expiring credit cards.
6.9) In the event that the goods for which the customer requests the return were ordered or made specifically for the customer, Norac may retain part of the amount paid by the buyer.

8) Warranty:
8.1) All products sold by Norac are covered by the manufacturer's standard warranty and the 24-month warranty for defects, pursuant to Legislative Decree 24/02. To benefit from warranty assistance, the Customer must retain the order confirmation received via email.
8.2) The manufacturer's standard warranty is provided according to the procedures illustrated on the website or in the documentation included in the product packaging. If, following intervention by an Authorized Service Center, the Manufacturer, or Norac, the defect is found not to be covered by the manufacturer's standard warranty, the Customer will be charged for any inspection and repair costs, as well as any shipping costs incurred by Norac.
8.3) The 24-month warranty pursuant to Legislative Decree 24/02 applies to products with a lack of conformity, provided that the product is used correctly, in compliance with its intended use and as provided in the attached technical documentation. This warranty is reserved for private consumers (natural persons who purchase the goods for purposes not related to their professional activity, or make the purchase without indicating a VAT number on the order form). In the event of a lack of conformity, Norac will, at no cost to the Customer, restore the product's conformity through repair/replacement or a price reduction, up to and including termination of the contract. If, following intervention by an Authorized Service Center, the Manufacturer, or Norac, the defect is not found to be a lack of conformity pursuant to Legislative Decree 24/02, the Customer will be charged for any costs of verification and repair, as well as any transportation costs incurred by Norac.
8.4) Replacements in the event of DOA (Dead On Arrival: product not working upon delivery) are only made if expressly provided for by the manufacturer. The time required for replacement or repair of the product depends exclusively on the manufacturer's policies.
8.5) In the event that, for any reason, Norac is unable to return a product under warranty to its customer (repaired or replaced), Norac may proceed, at its sole discretion, to refund the entire amount paid or to replace it with a product of equal or superior characteristics.
8.6) No damages can be requested from Norac for any delays in carrying out repairs or replacements.
8.7) In cases where the application of the warranty requires the return of the product, you must contact Norac by telephone; an operator will provide all the necessary information. When calling, you must have the purchase receipt (invoice, receipt, warranty certificate) issued by Norac available. Norac reserves the right not to provide a warranty on the product or motorcycle without the relevant purchase receipt or warranty certificate. The operator will provide an RMA (Return Merchandise Authorization) number to be placed on the outside of the return package. Shipments without an RMA number on the package will not be accepted by the Norac warehouse. The product must be returned by the Customer in its original packaging, complete in all its parts (including packaging and any documentation and accessories: manuals, cables, etc.). To limit damage to the original packaging, we recommend placing it in a second box or in the packaging used for the outgoing shipment. In all cases, applying labels or adhesive tape directly to the original product packaging should be avoided.
8.8) Any intervention carried out by personnel not authorised by Norac will immediately void the warranty.
8.9) A warranty intervention leaves the duration of the product warranty period completely unchanged.
8.10) The warranty will not be valid in cases where the product failure is caused by improper use, incorrect installation, assistance, maintenance or repairs carried out by technicians not authorised by Norac.
9) Approval
9.1) With the exception of products defined in the description with the terms "approved" and/or "street legal", the products sold by Norac are not approved for use on public roads. They are intended solely for use in sporting events on the track or on closed circuits, as well as trade shows and exhibitions. Approval is limited to countries within the European Union.
10) LIMITATION OF LIABILITY - DISCLAIMER
10.1) INFORMATION ON THIS SITE: We strive to keep this site as up-to-date as possible. Using products not intended for road use may be considered a crime, punishable by a fine, arrest, or otherwise prosecutable under the laws of the country in which they are used. Norac disapproves of the use of products not intended for road use outside of sporting events, racetracks, closed circuits, trade shows, or exhibitions.
Applicable law
10.3) The sales contract between the Customer and Norac is deemed to have been concluded in Italy and is governed by Italian law. For the resolution of civil and criminal disputes arising from the conclusion of this distance selling contract, if the Customer is a consumer, the territorial jurisdiction is that of the relevant court of his or her municipality of residence; in all other cases, the territorial jurisdiction is exclusively that of the Court of Vicenza.
